HEADLINE - MONDAY MORNING TO-DO LIST!!!!!

1) Call FEMA Fraud Unit and report what is going on around
FCC... call 1-800-323-8603... and tell them that over a
MILLION DOLLARS has been sent to FCCA to be distributed to
the flood victims and that Chet and the Board are not
telling you exactly how much you should be getting and will
not answer your questions about the money. Tell the FEMA
Fraud Unit that Chet and the Board have canceled the Annual
Meeting where they were supposed to answer questions and
that they have not issued a monthly management report in
four months showing you how much money has been coming in to
them. The more people that complain, the more likely that
the FEMA Fraud Unit will get involved so that you will not
have to spend any of your money on attorney's fees. Chet
and the Board are still potentially hiding over $200,000.00
of YOUR flood insurance settlement money!!!! It's up to YOU
if YOU let them get away with it!!!!! I can only give you
"Information".

2) Call Chet Hingle at his home 455-4520 or cell 234-9980,
call Sultan Mirza at 703-236-9562 and then put it in writing
by sending an email to both Chet and Sultan Mirza (by
replying to ALL on this email)... and ask them when are you
going to get the rest of your "1/2" of your money?????
That's right.. Chet and the Board are now giving out 1/2 of
the itemized estimate amounts to the front courtyard flood
victims and the four feet up storm victims. Since a 2BR
flood victim unit in the rear courtyard is supposed to get
around $23,000.00, according to the itemized estimate that I
made available to you, you should have gotten $11,500.00,
instead of only $7,500.00 that they gave you back at the end
of October. They still owe you $4,000.00 more.. just to be
giving you 1/2 like they said they would. They are still
possibly hiding the 20% Contractors Overhead and Profit from
the front courtyard victims, since at least one owner told
me that figure was not on their itemized estimate. If the
front courtyard estimate is like the rear courtyard
estimate, then the 20% is added on at the end of the
estimate and amounts to nearly $100,000.00 for each
courtyard, so maybe some games are being played by Chet and
the Board, yet again!!!!

3) Ask Chet and the Board when the leaking roofs are going
to be completed, including gutters and downspouts so that
water will quit running into upstairs repaired units and
down the insides of the brick walls into several downstairs
units. These owners can't even begin to repair their units
since they flood every time it rains. Chet and the Board
also need have a professional contractor "seal" the bricks
on the walls that leak so profusely. I previously published
how this could be done rather inexpensively, compared to
previous technology.. with money that was already in the
"Replacement Account" (reserve account), which amounted to
nearly $30,000.00 back in August, 2005.

4) Last, but not least... if you are still waiting on money
from your private insurance company, attached are the
documents that you need to complete and send or fax to the
Louisiana Commissioner of Insurance so they can help you
with your individual claims. Unless you complain, they will
never be able to help you! I know of several people who
have used this "tool" and their insurance company
immediately contacted them!!!!

And doing these 4 things will get you on the way to having a
HAPPY NEW YEAR!!!

I hope and pray that everybody is having a wonderful
Christmas Eve and that you all will have a blessed Christmas
Day.

"SILENT NIGHT"... THE NEW THEME SONG FOR CHET AND THE
BOARD...STILL SO MANY QUESTIONS AND NOT MANY ANSWERS FROM
ANY OF THEM!!!!!

I know it is still very rough out there for all of the
displaced families who are forced to stay in motels, hotels,
FEMA trailers or with friends and relatives.. while Sultan
Mirza lives in his home up in the Washington, DC beltway
area, while James Williams lives in his warm and toasty 2nd
floor condo at FCC and while Chet Hingle lives in his
two-story home on Transcontinental Dr. with his FEMA trailer
parked out front so he can have a kitchen to use. That's
right... while he refuses to allow other FCC families to
have a FEMA trailer, he is wasting a FEMA trailer for use as
a kitchen, while he lives in his two-story home!

I continue to get daily emails and phone calls from people
wanting to know information... information that only Chet
and the Board can provide... yet they still remain silent,
unless they spend two pages of a typed letter, FULL OF LIES,
in their attempts to attack me!

Well, Chet and the Board... I can handle your petty
attacks... BUT YOU SHOULD BE SPENDING ALL OF YOUR EFFORTS ON
DOING YOUR JOBS AND TYPING OUT A TWO-PAGE LETTER OF
INFORMATION, RATHER THAN ATTACKING ME WITHOUT PROVIDING ANY
INFORMATION!!!!

Will this just be another "Silent Night" on your part? Or
will you finally start giving the FCC owner's answers to
their many questions?

MAYBE THE TIDE IS TURNING?????

Maybe, just maybe, the Board is finally starting to hear the
questions, concerns and complaints of the hurricane victim
owners at FCC.

My understanding is that at least one of the owners in the
roof damaged rear building of the rear courtyard got a check
for half of their damages and ACTUALLY GOT A COPY OF THE
ITEMIZED INSURANCE ESTIMATE, concerning the roof damage
things in their unit, as well!

I haven't seen the original documents to know if the copy
they received was altered or if it was from an earlier,
lower estimate, SINCE IT WAS DATED 11/03/2005, but at least
they got an itemized estimate showing what the insurance
company says they were going to be paid. They said that the
estimate was from GAB Robins North America, Inc., 4111 S.
Sherwood Forest Blvd., Suite 2-A, Baton Rouge, LA 70816, so
if the estimate is not the correct copy, a properly placed
subpoena will produce the correct estimate. The Adjuster
seems to be Frank Edwards, Regional GA. The Policy Number
is 00991260 (probably a Scottsdale Insurance Company number)
and there is no claim number on this estimate but hopefully
it's just because it was the three pages dealing with the
particular unit. The total damages, according to the
estimate, for just "four feet up", is over $15,000.00 for a
3BR unit. I'm sure I will be getting some copies of the
various itemized estimates soon and I will publish what I
can when I receive them.

That money along with the over $35,000.00 that the Flood
Insurance paid for four feet down (for a 3BR unit) should be
enough to properly renovate and possibly even make things
better than they were before Katrina. These poor families
sure need a little good news for a change!!!!!

An interesting thing that I found on the Internet at FEMA's
website is the attached FEMA Brochure which says that if a
dwelling is insured for at least 80% of the replacement
value, then FEMA/NFIP will pay the RCV (Replacement Cost
Value) rather than the ACV (Actual Cash Value) for repairs.
This could amount to thousands more to each flood victim
since it would do away with the Depreciation difference. I
understand that the RCV was paid on the Scottsdale Insurance
Company claims so hopefully the Board can get NFIP to pay
the RCV as well.

Now, if only Chet Hingle would get a contractor to finish
the roofing work and seal the bricks so water will quit
flowing into the rear building downstairs units, then these
owners could get to work on renovating their units. Please
note that these leaking brick walls are a long term problem
and several owners have complained to Chet Hingle about
these things way before Katrina but Chet Hingle just
dismissed their complaints and concerns.. well.. all but
Sultan Mirza's where they spent thousands of dollars, doing
a half-assed job, instead of doing it right!!!!! Needless
to say, it still leaks in Sultans unit too! So much for
"Professional" management!

JUST IN CASE THE TIDE ISN'T TURNING, here is the FEMA Fraud
Department phone number... 1-800-323-8603. I'm sure you can
call them and find out more information about the total
claim amount and whether you got all of the money you were
supposed to get!!!!!

NOW ON TO THE "LIE'S" LETTER THAT CHET HINGLE PUT OUT ON
12/13/05.. DATED 12/12/05....

THAT'S RIGHT.. I CALL IT THE "LIE'S" LETTER SINCE THAT IS
ALL IT CONTAINS ABOUT DENNIS P., MYSELF AND "THE FOUNTAIN OF
INFORMATION"... NOTHING BUT "LIE'S"!!!!!

Attached, are copies of the OVER $519,000.00 worth of
Fidelity National Insurance Company checks that were sent to
Dennis P. in response to his PERSONAL claim with the Flood
Insurance Program. You will see that two of the checks are
dated 10/24/05 (totaling $155,000.00) and were received by
Dennis P. in late October, at the same time that the rear
courtyard was receiving their advance money so he did not
know what these checks were for and he did not trust Chet
Hingle or the Board so he told his Attorney about the checks
and waited for the next step. Since nothing happened and
the rear courtyard owners were paid $163,500.00 out of the
$200,000.00 advance, he figured that the insurance company
must have screwed up big time and send him duplicate checks.

Not until early December, when he received three more
Fidelity National Insurance Company checks, dated 11/21/05
(MAILED during the Thanksgiving holidays), did he realize
that he might have the actual insurance checks for the rear
courtyard... so he called me and told me about it so I could
publish that fact so that all owners would be aware of the
money... not just Chet and the Board.

During this same time period, I was putting pieces of the
puzzle together and realized that the policy number on his
checks were for the front courtyard.. not the rear
courtyard.... so Chet Hingle never did check with the
Insurance Company back in October to find out where the
front courtyard advance payment was????? He just blew off
the front courtyard victims for two more months and it
wasn't until he was looking for these three other checks
that he called the insurance company and found out they had
been mailed to Dennis P.. He called Dennis early on a
Tuesday morning (12/6/05) to see if Dennis P. had the checks
and Dennis acknowledged that he did and also told Chet about
the previous two checks. Dennis told Chet that Chet could
pick up the checks at Dennis' attorney's office. This was
all reported prior to Chet's "LIE'S" letter of 12/13/05.

According to Chet's "LIE'S" letter, these checks have a
"Stop Payment" so they are only collectors items now, but at
least all of you front courtyard flood victims have a copy
for your records. Chet's "LIE'S" letter claims that Dennis
had all of these checks back in October... WHICH IS A LIE...
but the bigger question is why did it take Chet two months
to track down the checks... or is the real truth that Chet
didn't care about the front courtyard flood victims since he
has, on a number of times, said "They only got wet
carpeting.. I don't know how much they think they are going
to get!".

Well, Chet, they got over a HALF MILLION DOLLARS!!!!! And
they should have had their advance money back in October if
YOU (Chet) weren't such a schmuck to people to where they
quit trusting YOU!!!!!

Now all you front courtyard owners need is a copy of your
itemized estimates and your FULL PAYMENT.... and hopefully,
with the change of the tide in the rear courtyard, you will
get that too!!!!!

EDITORIAL REPLY -

I still think that the Board needs to have a Special Meeting
just to "disclose, discuss and review" all of the financial
and insurance information so they can lift the aura of
mis-trust that surrounds the Board right now. The Board
also needs to admit to the owners what their secret plan was
for the hundreds of thousands of dollars they were hiding
from the owners. There are enough signatures on the
Petition to call a Special Homeowners Meeting but will the
Board schedule it???

The Board also needs to take proper disciplinary action
against Chet Hingle for his meanness, rudeness,
unprofessionalism and VULGARITY towards the various owners,
tenants and guests over the past 3 1/2 months.

Once these things are done, things will start to get back to
"normalcy" around here. I use that word because that is
what Sultan told me was his goal for FCC. I sure
hope he eventually stands up for what is right... instead of
letting Chet Hingle intimidate him so much!!!!!

Poor President Sultan must now know what President Bill
Clinton felt like when Hillary went on one of her many
dish-throwing tirades!!!! Unfortunately, like President
Clinton, Sultan still doesn't know what the definition of
"is" is! At least that's what it seems like, since he
hasn't followed the simple bylaws for the past 3 1/2 months!

Remember... "Illustrating absurdity by being absurd!".. (My
regards to Rush Limbaugh!)

Hi Sultan,

I've been hearing from several tenants... that when they
went to Chet to ask him for information, he told them, "Go
ask Lenny, he's the manager!" and then ignored their further
questioning.

You could have told me that I was hired. Do you need my
social security number for payroll? Where am I supposed to
pick up my checks? :-D

How long are YOU going to allow Chet to act this way to
people? You know he has cursed out over a dozen people. He
has walked off on dozens of others. He has been rude to
countless numbers. When will YOU make him start acting like
the so-called professional manager that he is supposed to
be?

James Williams also told people the same types of things.
You know that I only started reporting the information that
I learned because the people around here were desperate for
information and Chet and the Board were not doing their jobs
of communicating to the people. As you saw in the emails
today, it has been two months since my first OPEN LETTER and
still, most people have not heard anything specific from
Chet and/or YOU! Why won't you just tell them ALL of the
information that you know so they will not be further
traumatized by this disaster?

Still your friend.. but I expect ALL OF MY FRIENDS to do the
right things in life.. as best they can!

A REVIEW OF THE PAST TWO MONTHS SINCE MY FIRST OPEN LETTER

That's right... it all started two months ago today when I
first published my OPEN LETTER to all tenants about how some
of their rights were being violated by the Manager and the
Board.

Here is a summary of the headlines since that time, just in
case you missed some of the earlier Newsletters. You will
also be able to use this summary as a time-line for any
legal action that you may take against Chester "Chet"
Hingle, Jr., and the Board of FCCA.

It all started with Chet's letter dated 10/17/2005 whereas
he was telling each of you your "so-called rights" and
setting you up for the low-balled estimate that he later
came out with. I saw the beginning of the injustice in his
letter and prepared my own letter for my customers and any
other interested parties.

10/19/2005 - (FIRST) LENNY'S OPEN LETTER TO CUSTOMERS
REGARDING YOUR INSURANCE CLAIMS (and information from my
Attorney) - 4 pages typed.

10/20/2005 - FCC Preliminary Claim of Loss figures released
by Chet and the Board giving you the first actual notice
that they were planning on confiscating some of your money.
Even though Chet and the Board already had the NFIP Itemized
Insurance Estimate in their hands, they were still not
disclosing that fact and they low-balled ALL 22 OWNERS in
the rear courtyard with figures of $12,000.00 for a 1BR,
$15,000.00 for a 2BR and $24,000.00 for a 3BR. These
figures only added up to $321,000.00 and I learned shortly
thereafter that the actual amount of the initial estimate
was OVER $400,000.00.

10/24/2005 - (SECOND) LENNY'S OPEN LETTER TO CUSTOMERS -
Disclosing some emails from Sultan Mirza and Chet Hingle and
also giving each of you the phone number to the Commissioner
of Insurance 1-800-259-5300 or 5301 so you could file a
complaint. If you need complaint forms, I now have a full
set that I could email to you.

10/26/2005 - I published more of Sultan's emails and also a
model "Condo Homeowners Bill of Rights" which calls for even
more rights than the current FCC bylaws provide each of you.
I don't know if this would even help with the current Board
and Manager since they have ignored all of your rights thus
far!!!!

10/26/2005 - After Sultan threatened me with legal action, I
consulted with my Attorney and he and I came up with the
idea of publishing a newsletter so that my sources would be
protected from Sultan's proposed legal action to find out
who they were.... thus "THE FOUNTAIN OF INFORMATION" was
born and I published the FACT that the estimate was OVER
$400,000.00!!!! I further provided more information about
the Courtyard Giveaway taking place in the rear courtyard on
October 30, 2005 and more information about the "Condo
Homeowners Bill of Rights" was released.

10/26/2005 - Late Night Edition - I published the FACT that
the rear courtyard flood victims were getting an advance
check of $200,000.00.... of which $36,500.00 was not
distributed to the victims!!!! THE FIRST ACT OF HIDING THE
MONEY!!!! I also published Sultan's reply to my previous
information.

10/28/2005 - Since the email list of subscribers had nearly
doubled in the first 10 days, I printed a recap of the
previous letters, emails and newsletters.

10/28/2005 - Late Breaking News - A Board Meeting was held
and I asked one of the Board Members, upon seeing them in
the courtyard... "Is it even legal for the Board to divert
flood insurance proceeds away from the flood victims to be
used on some other common project?" Of course, they never
answered the question.

10/31/2005 - Urgent Breaking News - AS PREVIOUSLY REPORTED,
notes just went up on the doors of the flood victims in the
rear courtyard telling them that they had some advance money
available to them. Of course, it was still missing
$36,500.00!!!!

10/31/2005 - Chet Hingle confronted me and CURSED ME OUT
USING VARIOUS FORMS OF THE "F" WORD and further stating that
I had no business communicating with the owners and tenants
at FCC. I ignored him but did call him an idiot as I walked
away!

10/31/2005 - I published a series of emails from Sultan
Mirza... answering but not really providing any details to
the victims. Sultan also explained Chet's cursing as "he is
stressed"... WELL... IF HE CAN'T HANDLE THE HEAT, GET OUT OF
THE KITCHEN!!!!

11/2/2005 - Since some of the Board Members and the Manager
were trying to shut me up, I decided to publish
(anonymously) some of the email replies that I had been
receiving.

11/4/2005 - Over two weeks since the first OPEN LETTER.
Some of the upstairs victims received their first letter
with their low-ball estimates. Still no official itemized
estimates are released by Chet or the Board. Board Member,
James Williams, floated the idea that another $5,000.00 may
be coming to the 1BR and 2BR flood victims in the rear
courtyard.... to try and quiet down the rumbling of the
crowd. Even that figure is still a low-ball of the actual
amount of the itemized estimates.... by several thousand
dollars!!!!

11/8/2005 - Fleur De Lis Construction has left after a
CURSING MATCH with none other than Chet Hingle, witnessed by
several people in the rear courtyard,... and there are still
many leaks in the "repaired" roofs and still many leaks in
the unrepaired roofs. Chet Hingle never even told them to
check the other roofs for damages, although I had given Chet
Hingle written notice of my leaks long before this date.
Further, there are still NO Monthly Management Reports
issued for August, September or October, 2005. Another
Board Member tried to play games with me and when I called
his bluff by calling 911, he buckled like a wet noodle!!!!
He never did apologize for that incident and I should have
reported his name and what happened... and I may just do
that in one of the upcoming "TFOI's".

11/8/2005 - A note went out on the doors of the front
courtyard storm victims... "From: Board of Directors, Date:
November 8, 2005, Re: Final Wind Storm insurance figures,
Front Building (added by this writer - Front Courtyard,
Rear/North Building), The Board has accepted a total
settlement for windstorm damage. You will be allowed up to
$32,178.00 towards repairs to your unit which must be
supported by receipts and canceled checks and a final
inspection by management. Included in the amount is a
depreciation figure which is reimbursable to the Association
after all units are completed. Please note that deductibles
and past due condo dues will be deducted from the above
amount. If you have any question, please call management,
504 234 9980." (Not Signed but that is Chet Hingle's cell
phone number).

I also saw on a 3BR downstairs unit in the Front Courtyard,
North Building, that the figure was a little over $41,000.00
for Windstorm and Flood. This figure was visible through
the clear plastic bag which the note was enclosed, printed
side of the paper and details of the financial amount
visible to the public.

OF COURSE, CHET AND THE BOARD NEVER DID GIVE THESE OWNERS AN
ITEMIZED COPY OF THEIR INSURANCE ESTIMATE EITHER!!!!!

Also, I finally acquired a copy of the Bylaws, Rules and
Regulations, etc., and scanned them into my computer so I
was able to email copies to several people who wanted them
for proposed legal action.

11/9/2005 - A BOARD MEMBER CONFIRMED THAT CHET HINGLE HAS
BEEN ON UNEMPLOYMENT SINCE HURRICANE KATRINA... EVEN THOUGH
HE IS ATTEMPTING TO "MANAGE" YOUR LIVES AND CONTROL YOUR
LIVES!!!!! ALSO, IT HAS BEEN CONFIRMED THAT NOBODY ON THE
BOARD OF DIRECTORS FOR FCCA WAS EVER ELECTED TO THEIR
POSITIONS. THEY WERE POLITICAL APPOINTEES WHO ARE OBVIOUSLY
SHOWING THAT THEY DO NOT REPRESENT THE HOMEOWNERS AT FCC.

11/10/2005 - Eileen G., an owner in the front courtyard,
asked that I publish her open letter, which I did... here is
a snippet -

"Lenny: You know that anyone has a year in which to file a
lawsuit. We need to hold the Dec. meeting, (it's only a few
weeks away) try to get some answers, get our condos repaired
and go from there. If the condos are not repaired the
complex will become derelict, and we will all lose our homes
and money. The problems with the roof need to be addressed
immediately...."

Well Eileen, the Board CANCELED the December Annual Meeting,
in violation of the bylaws and Louisiana Law.... and ALL OF
THE HOMEOWNERS are going to lose money on the resale of
their units due to the low-ball figures given to most, if
not all of the owners, Most owners are having to go with
contractor grade materials rather than better materials
which will affect their resale values.. and those resale
values affects everyone's appraised value!!!!!

FURTHER, IT HAS BEEN OVER A MONTH SINCE YOUR OPEN LETTER
AND MY ROOF.. AND MANY OTHER ROOFS ARE STILL LEAKING LIKE A
SIEVE WHEN IT RAINS... CAUSING FURTHER AND CONTINUING

11/14/2005 - ANNUAL HOMEOWNER'S MEETING PROXY PREPARED AND
SENT OUT AS AN ATTACHMENT TO THE "FOI". UNFORTUNATELY, CHET
AND THE BOARD CANCELED THE ANNUAL MEETING... SO THEY WOULD
NOT HAVE TO ANSWER ANY OF YOUR QUESTIONS!!!!!

11/15/2005 - I NEED YOUR HELP! - I asked for and received
copies and phone calls with information about the various
amounts offered to each victim so I could compile a
spreadsheet... so that each owner could see what amounts had
been offered to their neighbors so they would know if they
were getting screwed over.. or rather, how bad they were
getting screwed over by Chet and the Board.

11/17/2005 - More information about the missing $80,000.00,
or now the missing $100,000.00 or more.. which ultimately
turned out to be the missing $200,000.00 or more!!!!!

And my Editorial Reply in that edition which still rings
true today.. over a month later!!!!! -

THE VICTIMS HAVE PAID THEIR CONDO DUES WHICH IN TURN PAID
THE INSURANCE PREMIUMS SO THE VICTIMS SHOULD BE GETTING ALL
OF THEIR MONEY... NOT JUST THE PART THAT CHET AND THE BOARD
FEEL THEY SHOULD GET, WHILE CHET AND THE BOARD ARE TRYING TO
BUILD UP A COMMUNITY CHEST OF ILL-GOTTEN MONEY!!!!

CHET AND THE BOARD SOMEHOW THINK THAT THE INSURANCE
SETTLEMENTS ARE THEIR MONEY, INSTEAD OF REALIZING THAT IT IS
THE VICTIMS MONEY AND THE BOARD IS ONLY THERE TO DISTRIBUTE
ALL OF THE MONEY TO THE VICTIMS. CHET AND THE BOARD DO NOT
HAVE ANY RIGHT TO KEEP EVEN ONE PENNY OF YOUR INSURANCE
SETTLEMENT MONEY. SOMEHOW THEY THINK THAT THEY ONLY HAVE TO
GIVE YOU PART OF THE MONEY AND THEY CAN KEEP THE REST!!!!
WHAT NERVE!!!! WHAT A PITIFUL SHAME THEY ARE BRINGING ON
THEM SELVES.!!!! HOW CAN THEY SLEEP AT NIGHT????

I HAVEN'T SAID IT YET, BUT IF THEY REALLY WERE TRYING TO
ENRICH THE COMMUNITY CHEST OR THEMSELVES, ON THE BACKS AND
WALLETS OF THE HURRICANE VICTIMS, THEN THERE IS A SPECIAL
PLACE IN....!!!

11/18/2005 - HOW MUCH ARE THE DEDUCTIBLES??? (They never
did tell you but I learned the deductible for the Flood
Insurance is only $500.00 which amounts to about $20.00 a
person in each courtyard... yet they kept implying it was
some big figure.. maybe as another way to confiscate some of
your money.)

11/21/2005 - THE ROOFS ARE STILL LEAKING!!! (The story
about Chet Hingle's CURSING OUT of the Fleur De Lis people
in the rear courtyard was also published).

11/24/2005 - Happy Thanksgiving!!! And Board Member, James
Williams, told one of the owners that Chet Hingle is now
employed by FCC FULL-TIME!!!! (I guess, now that he
qualified for his FEMA trailer, he could go back on the
payroll milking some of the ill-gotten money from the
community chest). ANOTHER OWNER WAS REFUSED ACCESS TO THE
FINANCIAL RECORDS OR MEETING MINUTES BY BOARD MEMBER JAMES
WILLIAMS... IN CONTINUING VIOLATION OF THE BYLAWS!!!!!

11/25/2005 - WEATHER ALERT.. BAD WEATHER IS COMING!!!!

11/26/2005 - CHET HINGLE HUNG NOTES UP ON THE MOSTLY VACANT
UNITS TELLING THEM... and I quote from that "FOI".

"The Board had adopted the 2005 operating budget for the
coming year, 2006. There will be no increase in monthly
dues at this time. (Editorial Reply - WOW!!! Imagine
that... they aren't going up on your dues next year... at
least, not "at this time". I guess with ALL of the
ILL-GOTTEN money that they are planning on confiscating from
the hurricane victim owners, they don't feel the need for an
increase!)

There will be NO Annual Owners Meeting in December. This
meeting will be rescheduled when FCC is back to normal and
all unit owners have returned to occupy their units.
(Editorial Reply - I DON'T THINK THEY CAN LEGALLY DO THIS.
THE BYLAWS ARE SPECIFIC ABOUT HAVING THE ANNUAL MEETING EACH
AND EVERY YEAR. Further, the Bylaws specifically state that
the NOTICE SHALL BE MAILED to each owner so the hanging of
the notice on the doors is not sufficient notice....
especially since most owners aren't even in their units.
WITH ALL OF THE UNANSWERED QUESTIONS, the Board and Manager
are just shirking their responsibility and fiduciary duty to
ALL of the owners. ARE YOU ALL GOING TO LET THEM GET AWAY
WITH THIS???? I SURE HOPE THAT SOMEONE HAS FILED SUIT
AGAINST THE BOARD BY NOW TO PUT AN END TO THEIR
SHENANIGANS!!!!!)"

via email.

12/6/2005 - HEADLINE - PETITION DRIVE IS MOVING FORWARD

The "Petition to allow FEMA trailers..." is being readily
accepted and signed by 95% of the people it has been
presented to. Only one person "did not want to get
involved" so far. This person did say that IF a second
"Petition for a Special Owners Meeting to discuss the
Insurance and Financial Information" is passed around, they
this owner would get involved in that petition and sign it!

STATE LAW CONCERNING ASSOCIATIONS -

I researched the Louisiana Legislature Website and found the
law concerning LA Corporations and Associations and it seems
we only need 10% (10 unit owners) to sign the petition in
order to FORCE the Board call a special meeting for the
owners to vote at that special meeting. Following this
paragraph is a copy/paste of the actual law. It also seems
that the FCC Board has been in violation of Louisiana Law as
it pertains to the number of Board Members. The law is very
specific and says a Board SHALL consist of no less than FIVE
Board Members and further... the Board is in violation of
the law since there SHALL be one or more REGULAR meetings
annually and the Board canceled the Annual Meeting scheduled
for this month.

12/6/2005 - MORE LATE BREAKING NEWS!!!!

In the past two days, I have had THREE different owners say
they are ready and willing to step up and become Board
Members should the current Board resign or be recalled. I
bet there are many more who are so frustrated by the current
Board's refusal to communicate and take control of the
so-called Manager.

12/7/2005 - Headline - HOLLYYYYYYY CRAAAAPPPPPPP!!!!!!

That was really the only headline that I could think of that
would properly set the tempo for this LATE BREAKING BIG TIME
NEWS!!!!!

About an hour ago, I received a phone call from a source
that had the exact amounts of the checks that have been
issued to FCCA from the National Flood Insurance Program...
for the rear Courtyard flood claim.

I first have to admit that I was mistaken about the "OVER
$80,000.00 MISSING" and I was also mistaken about the "OVER
$100,000.00 MISSING"... well, actually I wasn't mistaken
since I did include the word "OVER"... because the actual
amount of MISSING MONEY, OR MONEY BEING HIDDEN FROM THE
FLOOD VICTIMS IN THE REAR COURTYARD WAS OVER $200,000.00.
That's right... OVER FIVE HUNDRED THOUSAND DOLLARS (OVER
$500,000.00) WORTH OF CHECKS HAVE BEEN ISSUED TO FCCA FOR
THE REAR COURTYARD FLOOD VICTIMS AND STILL, THE BOARD IS
ONLY TELLING THE VICTIMS ABOUT $321,000.00 BEING AVAILABLE
TO THEM TO RENOVATE THEIR FLOODED UNITS.

The exact check amounts issued to FCCA are as follows:
around 10/21/05 - $5,000.00
around 10/21/05 - $150,000.00 (There may be another
$150,000.00 check also!)
around 12/1/05 - $317,465.79
around 12/1/05 - $46,763.61
around 12/1/05 - $600.00

(CORRECTION - THE CHECKS DATED AROUND 12/1/05 WERE ACTUALLY
ISSUED AROUND 11/22/05 BUT DID NOT ARRIVE UNTIL AROUND
12/1/05.... CHET HINGLE AND THE BOARD, IN THEIR 12/12/05
LETTER CLAIMED THAT THE CHECKS WERE BEING HELD BY THE UNIT
OWNER OF #58, "SINCE OCTOBER" AND THAT WAS NOT TRUE FOR MOST
OF THE CHECKS!!!!)

12/8/2005 - HEADLINE - WILL CHET AND THE BOARD GIVE YOU MORE
OF YOUR MONEY???

WOW!!!! A lot has happened in the past three days and
yesterday was a real DOOZIE so I'll get to the headline in a
minute!

I must be doing something right around here, because Chet
Hingle, ONCE AGAIN, stuck his finger in my face and told me
to "GET OUT OF HERE" and "SHUT-UP" to which I reminded him
that I live here and he can't tell me where to walk and then
I raised my voice even louder when I told him that he can't
make me "SHUT-UP"!!!!! Then he got in my face and I told
him... "Go ahead, hit me, so I can have your A$$ arrested
and carted out of here!!!"... along with a few other choice
comments! :-D....

...NOW WE ALL KNOW THAT THE INITIAL PAYMENT WAS LESS THAN
ONE THIRD (1/3) OF THE TOTAL AMOUNT THAT WAS ALLOCATED TO
EACH FLOOD VICTIM AND THAT MOST OWNERS SHOULD BE RECEIVING
OVER THREE TIMES THE AMOUNT OF THE INITIAL PARTIAL
PAYMENT... UNLESS CHET AND THE BOARD ARE STILL PLANNING ON
HIDING OR CONFISCATING SOME OF YOUR MONEY!"

12/11/2005 - A FCC FAMILY NEEDS YOUR HELP!!!

I received the following email this morning and I thought it

is. We have over 40 owners/tenants on the newsletter
mailing list and many more get printed copies. I hope and
pray that everyone will come together on this much needed
help.

I am not sure who all is on your mailing list, but I thought
it was important enough to write back and let everyone know
the situation.

My family (we live in #XX) lost everything in Katrina -
nothing but boards are left of our home. We have 3 young
boys (7,8,and 9) who have been living in one room on the
floor since the hurricane. O's job has opened back up and
we are all trying to make it. A family in Mandeville has
taken us in, but the house is crowded with others and the
boys are still on the floor.

While most kids Christmas lists consists of toys - MY KIDS
ARE ASKING FOR A PLACE TO LIVE AND A BED TO SLEEP IN! This
is not a third world country! The Federal Gov't. approved
our site for a trailer so my kids could have a "little spot"
to call their own by Christmas, and CHET HINGLE AND THE
BOARD STOPPED THEM FROM HOOKING UP THE TRAILER!!!

Chet's own words to me were "we don't want it to look like a
trailer park"! NEITHER DO WE, CHET!!! WE JUST WANT A BED
FOR OUR KIDS AND TO FIX UP OUR HOME SO WE CAN MOVE ON WITH
LIFE!!!

My children are in need of your help! Please, don't turn
your back on these boys right here at Christmas time.

ALL OF YOU CAN HELP - Our FEMA attorney says that all we
need is a signature from someone on the board and the
trailer can come back and be hooked up or if the board
member will not sign it - we need more than 1/2 of the unit
owner's to sign it. THIS IS TEMPORARY GUYS!!

Do you think that I want to live in 30' with three boys for
a long time - NO! We just need a place until we can get our
unit fixed!

PLEASE HELP US! There is a trailer waiting for us and my
boys could have a bed by Christmas Eve. Please, help it to
happen.

12/12/2005 - SOMEBODY RECENTLY WROTE ME SAYING THAT CHET
HINGLE IS ONE OF THE BEST PROPERTY MANAGERS IN THE AREA

Now, bear in mind that I have been involved in Management of
my own business and other people's businesses for the past
25 years and COMMUNICATION is a critical part of Management!

I Googled for website's concerning Homeowner's Associations,
Management Problems, Board Problems, etc., and it seems the
NUMBER ONE REASON for most problems is POOR COMMUNICATIONS
between the Board, Manager and Homeowners.... THE SAME
PROBLEMS WE ARE HAVING HERE AT FCC.

12/13/2005 - EDITORIAL REPLY -

SURPRISE!!!!! THEY CAN ACTUALLY COMMUNICATE!!!!!

Earlier today, three page letters were put on some doors
around FCC. I wasn't around all day so I did not receive
notice till this evening around 7:30 p.m.

See the attached "Attack Letter" that I had predicted in the
December 10th edition of "The Fountain of Information". I
also told you they would try to blame their mis-management,
malfeasance and their comedy of errors on the unit owner of
#XX, whom they identified as D. P., in their personal
attacks on him. I knew they would try to blame things on me
but I've told everybody what has been happening on nearly a
daily basis so you can go back and read the previous
editions starting with my first open letter on 10/19/2005.

Here is the actual quote from the December 10th, 2005
edition, where I predicted this attack:

"I'm sure that Chet and the Board will try to blame this
owner for the debacle but if Chet and the Board had been
properly communicating with ALL OWNERS from the beginning,
this owner would never have filed their own claim and there
would never have been the mis-trust that currently exists
between most of the owners and the Manager/Board... whom are
supposed to be representing the owners but have MISERABLY
failed to do so!!!!"

12/14/2005 - THEY LIED ABOUT THE REAR COURTYARD FLOOD CLAIM
AMOUNT!!!!

AND NOW I HAVE THE PROOF!!!!!

Somebody got FEMA to send them the original estimate for the
rear courtyard flood victims and they just now forwarded it
to me. I am now in possession of the actual ITEMIZED
estimate for the rear courtyard flood victims and Chet
Hingle and the Board LIED TO ALL OF YOU ABOUT THE TOTAL
AMOUNT AND ALSO ABOUT THE AMOUNT ALLOCATED FOR EACH
UNIT!!!!! If you are a rear courtyard flood victim and you
want a copy of this document, please send me an email or
call me at 504-621-1870. This deals with your personal
claim so I am not releasing the actual document at this
time.

Just from my quick scan of this over 100 page document and
the 1BR units were allocated over $16,000.00 each.... yet
Chet Hingle and the Board told you that you were only
getting $12,000.00... THEY LIED TO YOU!!!!!

2BR units were allocated nearly $19,000.00 each. Chet and
the Board told you $15,000.00... THEY LIED AGAIN!!!!

3BR units were allocated nearly $30,000.00 each. Chet and
the Board told you $24,000.00 and then $26,000.00... THEY
LIED TWO MORE TIMES!!!!!

At the end of the total estimate, there are figures added
for Contractor Overhead and Profit as well as some other
figures which total nearly $100,000.00 that was not included
in each unit owners estimate so that is why the actual
figures should be around 20% more for each owner... so each
1BR should get $16,000.00 plus 20%. Each 2BR should get
$19,000.00 plus 20%. Each 3BR owner should get $30,000.00
plus 20%. When this document is actually released, you will
see what I am talking about. There is also a figure in for
trash removal.. in the amount of $12,285.00 so don't let
them charge you for that if the bill is less than that
amount. (Correction - Please note that the originally
published "25%" figures have been corrected to read 20%.)

12/15/2005 - Headline - HERE IS THE ITEMIZED ESTIMATE!!!

The entire document is over 120 pages so I am not sending
the entire document to everyone but I am sending the summary
pages, showing the OVER $500,000.00 ESTIMATE for the rear
courtyard. I am also sending the itemized estimate for
Sultan Mirza's unit #48, since he previously told me that he
had a copy of the itemized estimate for his unit (that Chet
Hingle had faxed to him) and it only added up to the
$12,000.00 figure that Chet and the Board had put out for
everyone else... all the while, Sultan Mirza had retained a
contractor who was charging him around $15,000.00, so I
think Sultan was privy to inside information that he was not
telling the rest of you... MAINLY THE FACT THAT HIS ITEMIZED
ESTIMATE WAS FOR OVER $16,000.00 PLUS 20% MORE!!! Since
Sultan got a copy of his itemized estimate, I have printed
out the 120 page estimate and if any other rear courtyard
flood victim wants a copy of THEIR itemized estimate, please
email me or call me and I will make you a copy. I can then
scan it into my computer and email it to you or you can come
pick it up.

the rear Courtyard is now decorated with some of the
Christmas decorations that survived Katrina.

Also, the rear courtyard now has up to six downstairs units
that are occupied by their owners/tenants. Several of them
are actually fully renovated but a few are still in various
stages of renovation but the owners are forced to live in
them due to the unavailability of other housing, the lack of
a FEMA trailer or other reasons.

National Television this past week!

ANOTHER VERY HOT RUMOR THAT IS FLOATING AROUND THE REAR
COURTYARD is that former Board Member, Fred R., is talking
about running for President of the Association.. presumably
because he is sick and tired of the way things are going
with the current Board and Manager. Fred has been a
supporter of Chet Hingle in the past but the rumors have it
that even Fred is disgusted with the way Chet Hingle is
doing things around here. Rumor has it that Fred thinks the
people should be allowed to live in FEMA trailers in the
back area of the property and he does not understand why
Chet Hingle is so against the idea... (Editorial comment -
...especially since Chet Hingle has a FEMA trailer in front
of his two story home on Transcontinental. Chet doesn't
want FCC to look like a trailer park but he doesn't seem to
mind if the residential area near Transcontinental and
Kawanee looks like a trailer park... since he is the
beneficiary of that trailer park!!!)

Has Fred R. joined the so-called "fanatical group of owners"
who want to take over the Board and Management? I sure hope
so. I understand that Fred R. had over 40 proxy votes at
the last homeowners meeting. Too bad the Chet and the Board
CANCELED this years meeting.. especially with all of the
questions that need to be answered!

Rumor also has it that Fred thinks that Chet and the Board
should give the victims EVERY PENNY THAT THE INSURANCE
COMPANY SAYS THEY SHOULD GET!!! Why do Chet and the Board
still think they have any right to your insurance settlement
proceeds?????

All of these outspoken rumors from Fred R. seems to have
evolved around an incident where Chet Hingle talked nasty to
Fred recently!!!!!

Maybe Fred R. has finally seen the light.. the same light
that so many others have been seeing and feeling for the
past 3 1/2 months! Maybe, when I finally showed Fred R. his
NFIP Itemized Insurance Estimate which, like all of the
other 1BR units, totals over $19,000.00... yet Chet and the
Board are still saying that he is only getting $12,000.00
according to their last written notice to homeowners nearly
two months ago.

Can Chet and the Board still get away with not paying
everybody ALL OF THEIR MONEY??? ONLY IF YOU LET THEM!!!!!

Even after it was exposed, by "The Fountain of Information",
that the front courtyard has had checks issued to FCCA
totaling over $500,000.00, the Board still has not admitted
to the rear courtyard how much they have received or
anticipate receiving for the rear courtyard. Chet and the
Board are still sending out notes to owners saying they will
only pay them "up to" a certain amount.. even though the
insurance company's have itemized the estimates to show each
owner exactly what they are entitled to.

When will each owner finally stand up for their rights and
DEMAND A COPY OF THEIR ITEMIZED ESTIMATE. BOTH THE FLOOD
VICTIMS AND THE ROOF VICTIMS need to know exactly what they
are entitled to... SO WHEN WILL CHET AND THE BOARD FINALLY
RELEASE THESE COPIES TO THE OWNERS?????

Information" about the information that has been reported
over the past two months... calling it all a bunch of lies.

CLARIFYING SOME INFORMATION ON THE ITEMIZED ESTIMATES

AND...

WHY CHET AND THE BOARD MAY HAVE COST ALL OF YOU THOUSANDS OF
DOLLARS IN EQUITY AND RESALE VALUE ON YOUR CONDOMINIUM!!!!!

I have slowly but surely been separating the 121 page
itemized estimate for the flood victims in the rear
courtyard so that each victim will get a copy of their
actual itemized estimate. The estimates are broken down
into each room of your unit. They have three columns... RCV
(Replacement Cost Value), DEP (Depreciation) and ACV (Actual
Cash Value). I am not positive but I believe you will only
get the ACV amount which is the RCV minus the DEP. This is
the amount (the ACV) that I have previously published for
each 1BR, 2BR or 3BR unit.... BUT it is still much more than
Chet and the Board ever told you about.

Besides the ACV amount, you are also entitled to an
additional 20% above your ACV total as the Contractors
Overhead and Profit amount, which is added to the ACV totals
at the end of the 121 page estimate (I erred when I typed
25% in the previous email).

Each unit owner needs to go through their own itemized
estimate looking for errors. Some mistakes that have been
brought to my attention thus far are as follows:

On the last page of your estimate, there is the section
dealing with Debris Removal. The 1BR units have 1 large
container itemized. Some of the 3BR units have 3 large
container's itemized and other 2BR and 3BR units have only 1
large container itemized so I would think that a 1BR unit
should get 1 container, a 2BR unit should get 2 containers
and a 3BR unit should get 3 containers. Each container is
estimated to cost nearly $500.00 so this could amount to an
extra $500.00 to $1,000.00 added to your estimate.

Some of the "Bedrooms" in the 3BR estimates only have "2
ft." listed for Sheetrock Removal and Replacement where it
should be "4 ft.", since the flood insurance covers 4 ft.
down. This could amount to a few hundred dollars too!

Some of the 3BR units had built in tiled shower stalls in
the master bath and the estimate only showed tub and
fiberglass wall removal, cleaning and replacement, which is
a much lower figure than replacing the tiled shower stall.
These shower stalls had to be destroyed in order to remove
the wet, moldy drywall, so it's not just a matter of
removing, cleaning and replacing the items... they were
destroyed.

PLEASE CHECK OVER YOUR ITEMIZED ESTIMATE TO SEE IF THEY LEFT
ANY MAJOR ITEMS OFF OF YOUR ESTIMATE!!!!!

YET ANOTHER REASON WHY CHET AND THE BOARD SHOULD HAVE GIVEN
EACH UNIT OWNER THEIR OWN ITEMIZED ESTIMATE WHEN THEY FIRST
RECEIVED THE ITEMIZED ESTIMATE BACK IN OCTOBER!!!!!

WHY CHET AND THE BOARD MAY HAVE COST YOU THOUSANDS OF
DOLLARS IN EQUITY AND RESALE VALUE ON YOUR CONDOMINIUM!!!!!

I wish each of you would have had this itemized estimate
several months ago when the first copy was sent to Chet and
the Board. This estimate is a good tool and guideline to
help you know what was being paid for to be repaired or
replaced in each room of your home. Further, NOT HAVING
this estimate and NOT BEING TOLD the actual amount of your
settlement amount MAY ULTIMATELY LEAD TO A LOWERING OF YOUR
PROPERTY VALUES IN THE COMING YEARS.

WHY DO I SAY THIS? LET ME EXPLAIN...

If you have a 2BR unit and you knew you were going to be
getting around $23,000.00, instead of the measly $15,000.00
that Chet and the Board put out back in October, you could
have planned to spend more money on your unit which would
have made it's resale value go UP.. if and when you ever
sold your unit. For example, if you knew that you had more
money coming, you might have gone with a much nicer kitchen,
nicer cabinets, nicer countertops, a better refrigerator and
a much nicer Oven and Cook-top w/built-in Microwave, etc.
You might have gone with a much nicer, luxurious bathroom.
You might have gone with ceramic tile, 6" baseboards, crown
molding, a decorative paint job, etc. All of these things
would have led to a higher resale value for each Condo that
is ultimately sold.

Since Chet and the Board misled all of you with the low-ball
estimate amounts, many unit owners are only going with
contractor grade cabinets and counters, 3" baseboards, no
crown molding, plain white paint, etc... so when their units
eventually are sold, for a MUCH LOWER AMOUNT, THAT LOWER
PRICE WILL NEGATIVELY AFFECT YOUR PROPERTY VALUE SINCE
APPRAISALS ARE PARTLY BASED ON THE PRICE THAT OTHER
PROPERTIES IN THE CONDO COMPLEX ARE EVENTUALLY SOLD.

IF MORE PEOPLE HAD "LUXURY" ITEMS AND FINISHES IN THEIR
CONDO'S AND THEY SOLD FOR MORE MONEY, THE VALUE OF
EVERYBODY'S CONDO WOULD GO UP IN VALUE.

THEIR FAILURE TO COMMUNICATE THE TRUE AMOUNT OF THE ESTIMATE
BACK IN OCTOBER COULD COST EACH OWNER THOUSANDS OF DOLLARS
IN EQUITY AND RESALE VALUE IN THE LONG RUN!!!

EVEN THE NON-VICTIMS WOULD HAVE BENEFITED FROM "LUXURY"
ITEMS IN THE RENOVATED UNITS... SO NOW EVEN THE NON-VICTIMS
ARE POSSIBLY LOSING THOUSANDS OF DOLLARS IN THEIR EQUITY AND
RESALE VALUE TOO!!!!!

On a funny note that I failed to mention in the past...
every time I send one of these newsletters, my email program
does a spell-check prior to sending the email. Whenever the
scan comes across the word "CHET", it thinks I made a typo

The entire document is over 120 pages so I am not sending
the entire document to everyone but I am sending the summary
pages, showing the OVER $500,000.00 ESTIMATE for the rear
courtyard. I am also sending the itemized estimate for
Sultan Mirza's unit #48, since he previously told me that he
had a copy of the itemized estimate for his unit (that Chet
Hingle had faxed to him) and it only added up to the
$12,000.00 figure that Chet and the Board had put out for
everyone else... all the while, Sultan Mirza had retained a
contractor who was charging him around $15,000.00, so I
think Sultan was privy to inside information that he was not
telling the rest of you... MAINLY THE FACT THAT HIS ITEMIZED
ESTIMATE WAS FOR OVER $16,000.00 PLUS 20% MORE!!! Since
Sultan got a copy of his itemized estimate, I have printed
out the 120 page estimate and if any other rear courtyard
flood victim wants a copy of THEIR itemized estimate, please
email me or call me and I will make you a copy. I can then
scan it into my computer and email it to you or you can come
pick it up.

For the several people who have already emailed me, your
copy is being emailed in a separate email following this
one.

Please note that TONIGHT, during a heated conversation with
Board Member James Williams, he told me (in front of
witnesses) that the "original estimate was ONLY over
$400,000.00" and that Chet Hingle was responsible for
getting it raised to OVER $500,000.00. I would love to
believe this but until they show everyone the "original
estimate", I can only go with what I have in front of me.
The most interesting blurp to pay attention to is that James
Williams admitted that the "original estimate" was "OVER
$400,000.00", which is the figure I reported nearly two
months ago after they only told the rear courtyard owners
that they were getting $321,000.00.... so he admitted to
hiding around $100,000.00 from the victims!!!!

Also, TONIGHT, James Williams admitted to me in front of
several witnesses that the Board had indeed received a
$200,000.00 check as the advance payment to the rear
courtyard flood victims back in October.... YET, THEY ONLY
DISTRIBUTED $163,500.00. THAT'S RIGHT.. IF YOU ADD UP THE
AMOUNTS GIVEN TO THE 22 VICTIMS (3 X $13,000 for 3BR, plus 7
X $7,500 for 2BR, plus 12 X $6,000 for 1BR, it adds up to
$163,500.00)... SO WHERE IS THE OTHER $36,500.00 THAT COULD
HAVE AND SHOULD HAVE BEEN ADVANCED TO THE REAR COURTYARD
FLOOD VICTIMS??? THIS AMOUNTS TO ANOTHER $1,500.00 ADVANCE
EACH, OR MORE... THAT THE OWNERS COULD HAVE HAD TO HELP PAY
SOME OF THEIR EXPENSES. IF THE BOARD IS USING THIS MONEY
FOR OTHER LEGITIMATE PURPOSES... THEN THEY SHOULD TELL
EVERYONE!!!!

NOW IS THE TIME FOR ALL GOOD MEN TO COME TO THE AID OF THEIR
CONDO ASSOCIATION!!!!

The original saying that I learned back in typing classes in
high school ended with "Country" rather than "Condo
Association" but the concept remains the same.

NOW IS THE TIME FOR EACH AND EVERY BOARD MEMBER TO LOOK AT
THEMSELVES IN THE MIRROR AND ASK THEMSELVES IF THEY HAVE
BEEN DOING THE RIGHT THING FOR THE HOMEOWNERS AT FCC? HAVE
THEY BEEN TOTALLY HONEST AND FORTHRIGHT? HAVE THEY GIVEN
THE OWNERS ALL OF THE INFORMATION THAT THEY COULD HAVE GIVEN
THEM? ARE THEY PROUD OF THEMSELVES?????

Louisiana Law requires a Board of at least FIVE members, so
that hopefully, at least one member would stand up and do
the right thing during times like these. It is much harder
to get FIVE people to agree to secrecy. It is much harder
to get FIVE people to maintain a conspiracy of silence. Too
bad that the FCC Board is not following Louisiana Law or
they may not have gotten away with their conspiracy of
silence for so long.

It's not over yet. Although I have revealed the amounts of
the flood insurance estimates, the Board still has not
revealed the actual estimates for the upstairs storm damaged
units, nor for the upper four feet for the down stairs
flood/storm damaged units. That claim is being handled by
Scottsdale Insurance Company and it has been more difficult
for me to develop contacts that would reveal any details. I
have previously published the Scottsdale, supervisor's name,
phone number and email address. If you need it again,
please email or call me.

I CANNOT PREDICT THE FUTURE... I CAN ONLY LOOK AT THE
PAST... AND THE PAST ACTIONS BY THE BOARD AND MANAGER DO NOT
LOOK GOOD FOR THE REST OF THE INSURANCE SETTLEMENT VICTIMS.

THAT'S RIGHT.. YOU ARE NO LONGER HURRICANE VICTIMS.. YOU ARE
INSURANCE SETTLEMENT VICTIMS... BEING FURTHER VICTIMIZED BY
YOUR BOARD AND MANAGER AND THEIR FAILURE TO GIVE YOU ALL OF
THE INFORMATION THAT YOU ARE ENTITLED TO! BUT... AS LONG AS
I AM GETTING NEW INFORMATION FROM MY MANY SOURCES, I WILL
CONTINUE TO DIVULGE THIS INFORMATION TO EACH AND EVERY ONE
OF MY NEIGHBORS AND FRIENDS!!!!

YOU SHOULD DEMAND AND FIGHT FOR EVERY PENNY YOU ARE DUE FROM
YOUR INSURANCE SETTLEMENTS... THAT YOU PAID FOR WITH YOUR
CONDO DUES!!!! THE BOARD AND MANAGER SHOULD JUST DISTRIBUTE
ALL OF THE MONEY PER THE INSURANCE COMPANY ESTIMATES BUT
THEY ARE STILL SAYING THAT YOU SHOULD JUST TURN IN YOUR
RECEIPTS AND THEY WILL PAY YOU "UP TO" A CERTAIN AMOUNT,
WITHOUT TELLING YOU THE AMOUNT THAT YOU ARE ACTUALLY
ENTITLED TO!!!

NOW, IF YOU WANT TO MAKE A DONATION TO THE BOARD OF ANY
MONEY THAT YOU HAVE LEFT OVER AFTER FULLY RESTORING YOUR
UNIT... THEN THAT IS YOUR RIGHT!!! BUT IT IS NOT THE
BOARD'S RIGHT TO JUST CONFISCATE SOME OF YOUR MONEY... AND I
MEAN THOUSANDS OF DOLLARS... WITHOUT YOUR EXPRESS
PERMISSION!!!!

THEY LIED ABOUT THE REAR COURTYARD FLOOD CLAIM AMOUNT!!!!

AND NOW I HAVE THE PROOF!!!!!

Somebody got FEMA to send them the original estimate for the
rear courtyard flood victims and they just now forwarded it
to me. I am now in possession of the actual ITEMIZED
estimate for the rear courtyard flood victims and Chet
Hingle and the Board LIED TO ALL OF YOU ABOUT THE TOTAL
AMOUNT AND ALSO ABOUT THE AMOUNT ALLOCATED FOR EACH
UNIT!!!!! If you are a rear courtyard flood victim and you
want a copy of this document, please send me an email or
call me at 504-621-1870. This deals with your personal
claim so I am not releasing the actual document at this
time.

Just from my quick scan of this over 100 page document and
the 1BR units were allocated over $16,000.00 each.... yet
Chet Hingle and the Board told you that you were only
getting $12,000.00... THEY LIED TO YOU!!!!!

2BR units were allocated nearly $19,000.00 each. Chet and
the Board told you $15,000.00... THEY LIED AGAIN!!!!

3BR units were allocated nearly $30,000.00 each. Chet and
the Board told you $24,000.00 and then $26,000.00... THEY
LIED TWO MORE TIMES!!!!!

At the end of the total estimate, there are figures added
for Contractor Overhead and Profit as well as some other
figures which total nearly $100,000.00 that was not included
in each unit owners estimate so that is why the actual
figures should be around 20% more for each owner... so each
1BR should get $16,000.00 plus 20%. Each 2BR should get
$19,000.00 plus 20%. Each 3BR owner should get $30,000.00
plus 20%. When this document is actually released, you will
see what I am talking about. There is also a figure in for
trash removal.. in the amount of $12,285.00 so don't let
them charge you for that if the bill is less than that
amount.

I still do not understand why there is such a big jump from
a 2BR to a 3BR but regardless, Chet Hingle and the Board
lied to each and every flood victim in the rear courtyard...
22 different flood victims and they were hiding thousands of
dollars from each of you. They can't blame it on the
adjuster or anyone else. The estimate is itemized by each
unit.
Hopefully, the amount allocated for the 3BR will stay at the
$30,000.00 range and that figure can be used to get more
money for the 2BR and 1BR units.

The Laundry room and Rec Room were each itemized as well.
Plus the laundry room had $5,600.00 for loss of the washers
and dryers added to it.

THE TOTAL AMOUNT FOR THIS ESTIMATE FOR THE REAR COURTYARD
FLOOD VICTIMS IS $564,051.02 WITH A DEPRECIATION FIGURE OF
$35,616.78 AND THE ACTUAL CASH VALUE BEING $528,434.24. MY
UNDERSTANDING IS THAT THIS DEPRECIATION FIGURE MAY BE PAID
TO YOU AFTER ALL OF THE UNITS ARE REPAIRED SO YOU EACH MAY
BE ENTITLED TO ANOTHER $1,000.00 OR MORE, ADDED TO THE ABOVE
FIGURES.

I WAS RIGHT ONCE AGAIN... THE ACTUAL AMOUNT THAT CHET HINGLE
AND THE BOARD WERE TRYING TO HIDE FROM THE REAR COURTYARD
FLOOD VICTIMS WAS OVER $200,000.00... AND THAT'S IF THERE
ISN'T A SUPPLEMENTAL AMOUNT THAT MAY BE ADDED TO THIS
ORIGINAL ESTIMATE SINCE THE FRONT COURTYARD GOT NEARLY
$520,000.00 IN CHECKS ALREADY.

CHET HINGLE AND THE BOARD ONLY TOLD THE REAR COURTYARD FLOOD
VICTIMS THEY WERE GETTING A TOTAL OF $321,000.00... WAY BACK
IN OCTOBER, AND NEVER TOLD THEM THE TRUE AMOUNT OF THEIR
CLAIM, SO MANY OF THESE OWNERS HAD TO SKIMP ON THEIR
RENOVATIONS AND REPAIRS BECAUSE THEY DID NOT KNOW THE TRUE
AMOUNT THAT THEY WERE TO GET.

THIS JUST PROVES THAT CHET HINGLE AND THE BOARD HAVE BEEN
LYING TO YOU... EVEN WITH THE LIMITED AMOUNT OF INFORMATION
THAT THEY WOULD TELL YOU.

I CALLED FOR FULL DISCLOSURE AND TRANSPARENCY OVER TWO
MONTHS AGO.. WHEN I WAS WORKING FOR THE ASSOCIATION.. AND
THAT IS PROBABLY WHY I WAS FIRED. THIS WAS ALL PART OF
CHET'S SECRET PLAN AND HE DID NOT WANT ME TO EXPOSE HIM AND
THE BOARD!!! WELL, I DID... OVER AND OVER FOR THE PAST TWO
MONTHS.. AND I JUST DID AGAIN!!!!!

CHET HAS TRIED TO SHUT ME UP VERBALLY BY TRYING TO
INTIMIDATE ME. CHET AND SULTAN HAVE TRIED TO SHUT ME UP IN
WRITING.. AND THEY HAVE EVEN THREATENED LEGAL ACTION AGAINST
ME FOR TELLING ALL OF YOU WHAT I LEARN.... THE TRUTH!!!!!

THEY EVEN TOLD DOZENS OF LIES IN THEIR THREE PAGE LETTER
THAT WAS DISTRIBUTED YESTERDAY... BUT THEY FINALLY HAD TO
ADMIT THE TRUTH OF THE TOTAL SETTLEMENT AMOUNT FOR THE FRONT
COURTYARD!!!!!

WHEN WILL THEY STOP THE LIES TO EVERYONE ELSE?????

SURPRISE!!!!! THEY CAN ACTUALLY COMMUNICATE!!!!!

Earlier today, three page letters were put on some doors
around FCC. I wasn't around all day so I did not receive
notice till this evening around 7:30 p.m.

See the attached "Attack Letter" that I had predicted in the
December 10th edition of "The Fountain of Information". I
also told you they would try to blame their mis-management,
malfeasance and their comedy of errors on the unit owner of
#XX, whom they identified as D. P., in their personal
attacks on him. I knew they would try to blame things on me
but I've told everybody what has been happening on nearly a
daily basis so you can go back and read the previous
editions starting with my first open letter on 10/19/2005.

Here is the actual quote from the December 10th, 2005
edition, where I predicted this attack:

"I'm sure that Chet and the Board will try to blame this
owner for the debacle but if Chet and the Board had been
properly communicating with ALL OWNERS from the beginning,
this owner would never have filed their own claim and there
would never have been the mis-trust that currently exists
between most of the owners and the Manager/Board... whom are
supposed to be representing the owners but have MISERABLY
failed to do so!!!!"

It is obvious that they are desperately trying to hold onto
their jobs... and keep the books hidden from everyone. Why,
I don't know, and neither will you until they finally open
the financial and insurance records for the owner's
inspection, as provided for in the bylaws... and which they
have REFUSED to do so far.

I stand by the things I've reported and I have readily
admitted that some of the information was based on secondary
sources and what would amount to courtyard rumors... since
the best source.. the Board and Manager... HAVE STEADFASTLY
REFUSED TO TELL PEOPLE WHAT WAS GOING ON!!!!! AND THEY
STILL DO!!!!!

THE GOOD THING ABOUT THEIR ATTACK LETTER IS THAT THEY HAVE
FINALLY ADMITTED THAT THE OVER $500,000.00 IN FLOOD
INSURANCE PAYMENTS WERE RECEIVED ON BEHALF OF THE FRONT
COURTYARD FLOOD VICTIMS. AT LEAST THEY CAN'T TRY TO
LOW-BALL THE FRONT COURTYARD VICTIMS LIKE THEY DID THE REAR
COURTYARD VICTIMS.... UNLESS THERE IS MORE MONEY THAT THE
BOARD AND MANAGER AREN'T TELLING YOU ABOUT. THEY WON'T SHOW
ANYBODY THE FINANCIAL AND INSURANCE RECORDS SO YOU STILL
HAVE TO RELY ON THEIR HALF-TRUTHS AND AMBIGUOUS STATEMENTS.

AS OF THIS DATE, THEY STILL ARE STANDING BY THEIR ORIGINAL
PAYMENT SCHEDULE FOR THE REAR COURTYARD, WHICH ONLY ADDS UP
TO $321,000.00 FOR THE REAR COURTYARD VICTIMS.... AND THERE
WERE MORE UNITS FLOODED WITH MUCH MORE WATER. MY
UNDERSTANDING IS THAT UP TO EIGHT (8) MORE UNITS WERE
FLOODED IN THE REAR COURTYARD, THAN IN THE FRONT COURTYARD.
I'VE BEEN TOLD THAT NONE OF THE FRONT BUILDING UNITS, IN THE
FRONT COURTYARD, WERE FLOODED. IF SOME OF THEM WERE
FLOODED, THEN I DIGRESS.

BUT... EVEN IF THE REAR COURTYARD WAS TO ONLY GET THE SAME
AMOUNT AS THE FRONT COURTYARD, THEN THE BOARD AND MANAGER
STILL HID NEARLY $200,000.00 FROM THE REAR COURTYARD OWNERS
AND VICTIMS.

WHEN WILL THE BOARD AND MANAGER FINALLY JUST TELL EVERYONE
THE TRUTH.. THAT IS, WHAT WERE THE ORIGINAL ESTIMATE AMOUNTS
FOR EACH COURTYARD AND HOW MUCH HAVE THEY RECEIVED ON BEHALF
OF EACH COURTYARD SO FAR.

WELL, AT LEAST THEY'VE ADMITTED TO THE $519,000.00 FOR THE
FRONT COURTYARD.. BUT ONLY BECAUSE THEY GOT CAUGHT
WITHHOLDING THE TRUTH FROM EVERYONE!!!! WHEN WILL THEY TELL
THE TRUTH... THE ACTUAL SETTLEMENT OFFER AMOUNTS... TO THE
REAR COURTYARD FLOOD VICTIMS... AND THE REST OF THE
HURRICANE VICTIMS IN THE FRONT AND REAR COURTYARDS.

GREAT NEWS FOR ONE OF OUR OWNERS!!!!

Congratulations are in order for Stacey, the owner of unit
#XX in the rear courtyard, for her new baby boy born on
December 7, 2005. Margie, the proud grandmother and my
neighbor, was living in unit #XX until Hurricane Katrina
took out their Air Conditioner Compressor and left a leaky
roof and ceiling in the bedroom. I hope our roof and air
conditioners / heating are repaired soon so Margie can
return or another new neighbor can move into the empty unit.

Once again... CONGRATULATIONS STACEY AND FAMILY!!!!!

And what a VERY MERRY CHRISTMAS PRESENT!!!!!

Now, bear in mind that I have been involved in Management of
my own business and other people's businesses for the past
25 years and COMMUNICATION is a critical part of Management!

I Googled for websites concerning Homeowner's Associations,
Management Problems, Board Problems, etc., and it seems the
NUMBER ONE REASON for most problems is POOR COMMUNICATIONS
between the Board, Manager and Homeowners.... THE SAME
PROBLEMS WE ARE HAVING HERE AT FCC.

Webster's dictionary defines communication as "an act of
transmitting information; a process by which information is
exchanged between individuals; a technique for expressing
ideas effectively".
It sounds so easy, doesn't it? What's so hard about good
communication? The answer to that question lies not in
understanding the concept of communication, but in
practicing effective communication in community association
management. It is the key that will open the door to good
client relationships.

Communicating with the Homeowners:

It is the responsibility of the association board of
directors to communicate the status of association
activities and board actions to the membership (homeowners)
within the association. Without this communication, members
in the community often tend to believe that the board may be
doing things that they shouldn't be doing - or doing nothing
at all! It's always better to provide too much rather than
too little information to those inquiring minds living
within a community association.

Several tools can be used to effectively communicate
information to the homeowners. The monthly meetings of the
association can provide a forum for the board members to
report on association activities. In addition, newsletters
and other forms of written communication, whether mailed,
hand delivered, or posted on a community bulletin board, can
be effectively used to distribute information to the
homeowners.

Association websites can also be developed and maintained at
minimal cost to homeowner associations. These websites can
be invaluable in the dissemination of information to the
members of the association and can contain financial
information, on-line newsletters, rules and regulations,
architectural guidelines, and governing documents as well as
other information that the board would like to pass on to
the membership.

In some instances, associations located within the
boundaries of certain cable franchises have been able to
negotiate their own local cable channel for making
announcements of upcoming events. Although this can be labor
intensive, it is a very effective means of providing current
information to the members of a large scale association.

In summary, good communication can be the deterrent to a
variety of ills that an association may otherwise encounter.
To be effective, communication must be timely and succinct.
A variety of tools exist for the establishment of
communication within an association. Both management and the
association board share responsibility for establishing and
maintaining communication between themselves and the
membership at large. Once they do so, they will likely have
mastered the art of building a long and satisfying
relationship among a very diverse community of interests.

Handling Angry Homeowners

KEEN COMMUNICATION SKILLS DIFFUSE HOSTILE RESIDENTS

When Rick Cummings, CMCA, became general manager of The
Waterford Condominiums in 1994, residents were uninformed
and angry. The 149-unit association in Kensington, Maryland
was plagued with personality conflicts and charges of secret
meetings and rigged elections.

"Homeowners become hostile when they aren't informed about
association issues and projects," said Cummings, who
combated unit owners' anger with increased association
communications.
Twice a year, the Waterford conducts a town meeting, where
Cummings and the association board discuss proposed projects
and solicit owner input. The Waterford also distributes an
annual Quality of Life survey to assess residents' level of
satisfaction with association staff, services and
improvement projects. This year, 65 percent of the
association's residents completed the survey.

At the Waterford, informed residents are happy residents.
After a year of planning and educating residents about a
five-year interior and exterior renovation, the Waterford
began construction. "Residents are excited about the
improvements," Cummings said. "Nobody has complained about
the loud construction or the mess."

Even though community managers can usually cure deep-rooted
anger by enhancing association communications, they still
must handle isolated incidents of upset residents.

When angry homeowners approach a manager, they want the
manager to listen to their complaints. "Listening seems like
a small thing," said Jon Devner, CMCA, manager of Leisure
World Community Association in Mesa, Arizona, "but in
reality, listening is very important.

"The worst thing you can do is react to a homeowner's
anger," Devner added. "First, listen to the owner. Then,
respond to the problem."

Patricia Ball, president of Corporate Communications, Inc.
in St. Louis, suggests managers follow these steps when
confronted with angry owners:

Step 1--Allow the homeowner to express his or her views

Step 2--Respond without lashing out

Step 3--Apologize for the situation without taking the blame

Step 4--Empathize with the owner

Step 5--Ask questions about the problem and solicit
solutions

Step 6--If you can solve the problem, tell the homeowner
when you will take appropriate actions

Step 7--Ask the homeowner if he or she agrees with the
proposed solution

Step 8--End the conversation in a pleasant manner, thanking
the owner for his or her time and help

Sometimes, homeowners become angry with managers when the
board hasn't addressed a particular issue, said Kenton
Krohlow, AMS, a community manager in Edwards, Colorado.
"When this happens, calm the angry owner and encourage the
board to work."

If a board of directors neglects to address the issue in a
timely manner, consider organizing an informal meeting where
the homeowner can speak with the board, Krohlow added. For
example, ask the parties to accompany you during a property
inspection if the problem involves a common area repair or
maintenance issue.

ON 6/17/04 AT THE BOARD OF DIRECTORS MEETING - PETITION FOR
REMOVAL HANDED TO PRESIDENT

On Thursday, 6/17/04, at 6 PM was the regularly scheduled
meeting of Alex Taylor's Board of Directors. I know many of
you have told me you have stopped coming to the meetings,
because Alex Taylor, the present President of the Board of
Directors, is disrespectful to the homeowners and renters at
the meetings, but this meeting was very different and
entertaining.

Many concerned homeowners had been looking forward to this
Alex Taylor's Board of Directors meeting, because we had
been gathering signatures on a petition for a special
election meeting to be presented to Alex Taylor's Board of
Directors and Euclid Management. Going door-to-door we had
gathered signatures on our petition from 31% of the
homeowners even though at only about half of the units we
went to did someone answer the door, some were renters not
homeowners, and we didn't even bother to get to all of the
doors as we only needed signatures from 5% or more of the
homeowners.

Park Mediterrania is a non-profit corporation. California
Corporation Code Section 7510 (e) states: "Special meetings
of members for any lawful purpose may be called by the
board, the chairman of the board, the president, or such
other persons, if any are specified in the bylaws. In
addition, special meetings of members for any lawful purpose
may be called by 5 percent or more of the members."

So only 5 % of the members are needed to call for a special
meeting and we easily gathered signatures on our petition
from 31% of the members. If we had gone back again and
knocked on the doors no one answered earlier, contacted the
owners of the rentals, and knocked on the doors we skipped,
I'm sure we would have gathered signatures from at least 85%
of the homeowners. Very few needed persuading to sign the
petition. Among the very few homeowners that refused to
sign the petition some probably were just undecided, not
followers of Alex Taylor's Board of Directors.

A FCC FAMILY NEEDS YOUR HELP!!!

I received the following email this morning and I thought it
would be best to just forward it in its entirety so here it
is. We have over 40 owners/tenants on the newsletter
mailing list and many more get printed copies. I hope and
pray that everyone will come together on this much needed
help. Names and Identifying information has been edited
out... EXCEPT for Chester "Chet" Hingle, Jr., the Manager,
and Sultan Mirza, the FCCA President.

Dear Lenny,

I am not sure who all is on your mailing list, but I thought
it was important enough to write back and let everyone know
the situation.

My family (we live in #XX) lost everything in Katrina -
nothing but boards are left of our home. We have 3 young
boys (7,8,and 9) who have been living in one room on the
floor since the hurricane. My husband's job has opened
back up and we are all trying to make it. A family in
Mandeville has taken us in, but the house is crowded with
others and the boys are still on the floor.

While most kids Christmas lists consists of toys - MY KIDS
ARE ASKING FOR A PLACE TO LIVE AND A BED TO SLEEP IN! This
is not a third world country! The Federal Gov't. approved
our site for a trailer so my kids could have a "little spot"
to call their own by Christmas, and CHET HINGLE AND THE
BOARD STOPPED THEM FROM HOOKING UP THE TRAILER!!!

Chet's own words to me were "we don't want it to look like a
trailer park"! NEITHER DO WE, CHET!!! WE JUST WANT A BED
FOR OUR KIDS AND TO FIX UP OUR HOME SO WE CAN MOVE ON WITH
LIFE!!!

My children are in need of your help! Please, don't turn
your back on these boys right here at Christmas time.

ALL OF YOU CAN HELP - Our FEMA attorney says that all we
need is a signature from someone on the board and the
trailer can come back and be hooked up or if the board
member will not sign it - we need more than 1/2 of the unit
owner's to sign it. THIS IS TEMPORARY GUYS!!

Do you think that I want to live in 30' with three boys for
a long time - NO! We just need a place until we can get our
unit fixed!

PLEASE HELP US! There is a trailer waiting for us and my
boys could have a bed by Christmas Eve. Please, help it to
happen.

PLEASE HELP YOUR NEIGHBORS AND FRIENDS DURING THESE
DISASTROUS TIMES. I AM ATTACHING THE ORIGINAL PETITION TO
ALLOW FEMA TRAILERS, WHICH HAS AROUND 20 SIGNATURES ALREADY.
IF YOU HAVE NOT SIGNED IT, PLEASE DO SO NOW AND RETURN THE
PETITION TO ME, IN UNIT #94, A.S.A.P.!!!!

AS SOON AS WE GET 48 SIGNATURES, O., L. AND THEIR CHILDREN
CAN AT LEAST HAVE A SMALL HOME OF THEIR OWN UNTIL THEIR
CONDO IS RENOVATED. SO CAN THE OTHER FCC OWNERS WHO HAVE
REQUESTED FEMA TRAILERS. ONLY AROUND SIX FAMILY'S HAVE
REQUESTED A FEMA TRAILER AND THERE IS ROOM FOR 20 IN THE
REAR GRASS AREA AND ALONG THE CANAL FENCE LINE.

LETS HELP THESE FEW FAMILIES THAT NEED OUR HELP. LETS HAVE
SOME COMPASSION FOR THESE VICTIMS OF HURRICANE KATRINA....
ESPECIALLY DURING THESE CHRISTMAS HOLIDAYS!
